Giudichiamo doveroso, con un nuovo intervento della Nostra autorità, sostenere e confermare – in quanto lo richiedono giusti e gravi motivi – le provvide leggi e le sanzioni dei Romani Pontefici Nostri Predecessori: non soltanto quelle leggi e quelle sanzioni il cui vigore o per il processo del tempo o per la noncuranza degli uomini temiamo si possano rallentare od estinguere, ma anche quelle che recentemente hanno ottenuto forza e pieno vigore.
1. Di fatto Clemente XII, Nostro Predecessore di felice memoria, con propria Lettera apostolica del 28 aprile dell’anno dell’Incarnazione del Signore 1738, anno ottavo del suo Pontificato – Lettera diretta a tutti i fedeli e che comincia In eminenti – condannò per sempre e proibì alcune Società, Unioni, Riunioni, Adunanze, Conventicole o Aggregazioni volgarmente chiamate dei Liberi Muratori o des Francs Maçons, o diversamente denominate, già allora largamente diffuse in certi Paesi e che ora sempre più aumentano. Egli vietò a tutti e ai singoli Cristiani (sotto pena di scomunica da incorrersi ipso facto senza alcuna dichiarazione, dalla quale nessuno potesse essere assolto da altri, se non in punto di morte, all’infuori del Romano Pontefice pro tempore) di tentare o ardire di entrare in siffatte Società, propagarle o prestare loro favore o ricetto, occultarle, iscriversi ad esse, aggregarsi o intervenirvi, ed altro, come nella stessa Lettera più largamente e più ampiamente è contenuto. Eccone il testo.
2. “Clemente Vescovo, servo dei servi di Dio. A tutti i fedeli, salute e Apostolica Benedizione.
Posti per volere della clemenza Divina, benché indegni, nell’eminente Sede dell’Apostolato, onde adempiere al debito della Pastorale provvidenza affidato a Noi, con assidua diligenza e con premura, per quanto Ci è concesso dal Cielo, abbiamo rivolto il pensiero a quelle cose per mezzo delle quali – chiuso l’adito agli errori ed ai vizi – si conservi principalmente l’integrità della Religione Ortodossa, e in questi tempi difficilissimi vengano allontanati da tutto il mondo Cattolico i pericoli dei disordini.
Già per la stessa pubblica fama Ci è noto che si estendono in ogni direzione, e di giorno in giorno si avvalorano, alcune Società, Unioni, Riunioni, Adunanze, Conventicole o Aggregazioni comunemente chiamate dei Liberi Muratori o des Francs Maçons, o con altre denominazioni chiamate a seconda della varietà delle lingue, nelle quali con stretta e segreta alleanza, secondo loro Leggi e Statuti, si uniscono tra di loro uomini di qualunque religione e setta, contenti di una certa affettata apparenza di naturale onestà. Tali Società, con stretto giuramento preso sulle Sacre Scritture, e con esagerazione di gravi pene, sono obbligate a mantenere un inviolabile silenzio intorno alle cose che esse compiono segretamente.
Ma essendo natura del delitto il manifestarsi da se stesso e generare il rumore che lo denuncia, ne deriva che le predette Società o Conventicole hanno prodotto tale sospetto nelle menti dei fedeli, secondo il quale per gli uomini onesti e prudenti l’iscriversi a quelle Aggregazioni è lo stesso che macchiarsi dell’infamia di malvagità e di perversione: se non operassero iniquamente, non odierebbero tanto decisamente la luce. Tale fama è cresciuta in modo così considerevole, che dette Società sono già state proscritte dai Principi secolari in molti Paesi come nemiche dei Regni, e sono state provvidamente eliminate.
Noi pertanto, meditando sui gravissimi danni che per lo più tali Società o Conventicole recano non solo alla tranquillità della temporale Repubblica, ma anche alla salute spirituale delle anime, in quanto non si accordano in alcun modo né con le Leggi Civili né con quelle Canoniche; ammaestrati dalle Divine parole di vigilare giorno e notte, come servo fedele e prudente preposto alla famiglia del Signore, affinché questa razza di uomini non saccheggi la Casa come ladri, né come le volpi rovini la Vigna; affinché, cioè, non corrompa i cuori dei semplici né ferisca occultamente gl’innocenti; allo scopo di chiudere la strada che, se aperta, potrebbe impunemente consentire dei delitti; per altri giusti e razionali motivi a Noi noti, con il consiglio di alcuni Venerabili Nostri Fratelli Cardinali della Santa Romana Chiesa, e ancora motu proprio, con sicura scienza, matura deliberazione e con la pienezza della Nostra Apostolica potestà, decretiamo doversi condannare e proibire, come con la presente Nostra Costituzione, da valere in perpetuo, condanniamo e proibiamo le predette Società, Unioni, Riunioni, Adunanze, Aggregazioni o Conventicole dei Liberi Muratori o des Francs Maçons, o con qualunque altro nome chiamate. Pertanto, severamente, ed in virtù di santa obbedienza, comandiamo a tutti ed ai singoli fedeli di qualunque stato, grado, condizione, ordine, dignità o preminenza, sia Laici, sia Chierici, tanto Secolari quanto Regolari, ancorché degni di speciale ed individuale menzione e citazione, che nessuno ardisca o presuma sotto qualunque pretesto o apparenza di istituire, propagare o favorire le predette Società dei Liberi Muratori o des Francs Maçons o altrimenti denominate; di ospitarle e nasconderle nelle proprie case o altrove; di iscriversi ed aggregarsi ad esse; di procurare loro mezzi, facoltà o possibilità di convocarsi in qualche luogo; di somministrare loro qualche cosa od anche di prestare in qualunque modo consiglio, aiuto o favore, palesemente o in segreto, direttamente o indirettamente, in proprio o per altri, nonché di esortare, indurre, provocare o persuadere altri ad iscriversi o ad intervenire a simili Società, od in qualunque modo a giovare e a favorire le medesime. Anzi, ognuno debba assolutamente astenersi dalle dette Società, Unioni, Riunioni, Adunanze, Aggregazioni o Conventicole, sotto pena di scomunica per tutti i contravventori, come sopra, da incorrersi ipso facto, e senza alcuna dichiarazione, dalla quale nessuno possa essere assolto, se non in punto di morte, da altri all’infuori del Romano Pontefice pro tempore.
Vogliamo inoltre e comandiamo che tanto i Vescovi, i Prelati Superiori e gli altri Ordinari dei luoghi, quanto gl’Inquisitori dell’eretica malvagità deputati in qualsiasi luogo, procedano e facciano inquisizione contro i trasgressori di qualunque stato, grado, condizione, ordine, dignità o preminenza, e che reprimano e puniscano i medesimi con le stesse pene con le quali colpiscono i sospetti di eresia. Pertanto concediamo e attribuiamo libera facoltà ad essi, e a ciascuno di essi, di procedere e di inquisire contro i suddetti trasgressori, e di imprigionarli e punirli con le debite pene, invocando anche, se sarà necessario, l’aiuto del braccio secolare.
Vogliamo poi che alle copie della presente, ancorché stampate, sottoscritte di mano di qualche pubblico Notaio e munite del sigillo di persona costituita in dignità Ecclesiastica, sia prestata la stessa fede che si presterebbe alla Lettera se fosse esibita o mostrata nell’originale.
A nessuno dunque, assolutamente, sia permesso violare, o con temerario ardimento contraddire questa pagina della Nostra dichiarazione, condanna, comandamento, proibizione ed interdizione. Se qualcuno osasse tanto, sappia che incorrerà nello sdegno di Dio Onnipotente e dei Santi Apostoli Pietro e Paolo”.
3. Ma poiché, per quanto Ci è stato riferito, alcuni non hanno avuto difficoltà di affermare e diffondere pubblicamente che la detta pena di scomunica imposta dal Nostro Predecessore non è più operante perché la relativa Costituzione non è poi stata da Noi confermata, quasi che sia necessaria, perché le Apostoliche Costituzioni mantengano validità, la conferma esplicita del successore;
4. ed essendo stato suggerito a Noi, da parte di alcune persone pie e timorate di Dio, che sarebbe assai utile eliminare tutti i sotterfugi dei calunniatori e dichiarare l’uniformità dell’animo Nostro con l’intenzione e la volontà dello stesso Predecessore, aggiungendo alla sua Costituzione il nuovo voto della Nostra conferma;
5. Noi certamente, fino ad ora, quando abbiamo benignamente concesso l’assoluzione dalla incorsa scomunica, sovente prima e principalmente nel passato anno del Giubileo, a molti fedeli veramente pentiti e dolenti di avere trasgredito le leggi della stessa Costituzione e che assicuravano di cuore di allontanarsi completamente da simili Società e Conventicole, e che per l’avvenire non vi sarebbero mai tornati; o quando accordammo ai Penitenzieri da Noi delegati la facoltà di impartire l’assoluzione a Nostro nome e con la Nostra autorità a coloro che ricorressero ai Penitenzieri stessi; e quando con sollecita vigilanza non tralasciammo di provvedere a che dai competenti Giudici e Tribunali si procedesse in proporzione del delitto compiuto contro i violatori della Costituzione stessa, il che fu effettivamente più volte eseguito; abbiamo certamente fornito argomenti non solo probabili ma del tutto evidenti ed indubitabili, attraverso i quali si sarebbero dovute comprendere le disposizioni dell’animo Nostro e la ferma e deliberata volontà consenzienti con la censura imposta dal predetto Clemente Predecessore. Se un’opinione contraria si divulgasse intorno a Noi, Noi potremmo sicuramente disprezzarla e rimettere la Nostra causa al giusto giudizio di Dio Onnipotente, pronunciando quelle parole che un tempo si recitavano nel corso delle sacre funzioni: “Concedi o Signore, te ne preghiamo, che Noi non curiamo le calunnie degli animi perversi, ma conculcata la perversità medesima supplichiamo che Tu non permetta che siamo afflitti dalle ingiuste maldicenze o avviluppati dalle astute adulazioni, ma che amiamo piuttosto ciò che Tu comandi”. Così riporta un antico Messale attribuito a San Gelasio, Nostro Predecessore, e che dal Venerabile Servo di Dio il Cardinale Giuseppe Maria Tommasi fu inserito nella Messa che s’intitola Contro i maldicenti.
6. Tuttavia, affinché non si potesse dire che Noi avevamo imprudentemente omesso qualche cosa, al fine di eliminare agevolmente i pretesti alle menzognere calunnie e chiudere loro la bocca; udito prima il consiglio di alcuni Venerabili Nostri Fratelli Cardinali della Santa Romana Chiesa, abbiamo decretato di confermare la stessa Costituzione del Nostro Predecessore, parola per parola, come sopra riportato in forma specifica, la quale sia considerata come la più ampia ed efficace di tutte: la confermiamo, convalidiamo, rinnoviamo e vogliamo e decretiamo che abbia perpetua forza ed efficacia per Nostra sicura scienza, nella pienezza della Nostra Apostolica autorità, secondo il tenore della medesima Costituzione, in tutto e per tutto, come se fosse stata promulgata con Nostro motu proprio e con la Nostra autorità, e fosse stata pubblicata per la prima volta da Noi.
7. Per la verità, fra i gravissimi motivi delle predette proibizioni e condanna esposti nella sopra riportata Costituzione ve n’è uno, in forza del quale in tali Società e Conventicole possano unirsi vicendevolmente uomini di qualsiasi religione e setta; è chiaro quale danno si possa recare alla purezza della Religione Cattolica. Il secondo motivo è la stretta e impenetrabile promessa di segreto, in forza del quale si nasconde ciò che si fa in queste adunanze, cui meritamente si può applicare quella sentenza che Cecilio Natale, presso Minucio Felice, addusse in una causa ben diversa: “Le cose oneste amano sempre la pubblica luce; le scelleratezze sono segrete”. Il terzo motivo è il giuramento con il quale s’impegnano ad osservare inviolabilmente detto segreto, quasi che sia lecito a qualcuno, interrogato da legittimo potere, con la scusa di qualche promessa o giuramento di sottrarsi all’obbligo di confessare tutto ciò che si ricerca, per conoscere se in tali Conventicole si faccia qualche cosa contraria alla stabilità e alle leggi della Religione e della Repubblica. Il quarto motivo è che queste Società si oppongono alle Sanzioni Civili non meno che alle Canoniche, tenuto conto, appunto, che ai sensi del Diritto Civile si vietano tutti i Collegi e le adunanze formati senza la pubblica autorità, come si legge nelle Pandette (libro 47, tit. 22, De Collegiis et corporibus illicitis), e nella celebre lettera (n. 97 del libro 10) di C. Plinio Cecilio, il quale, riferisce che fu proibito per suo Editto, giusta il comandamento dell’Imperatore, che si tenessero le Eterie, cioè che potessero esistere e riunirsi Società e adunanze senza l’autorizzazione del Principe. Il quinto motivo è che in molti Paesi le citate Società e Aggregazioni sono già state proscritte e bandite con leggi dei Principi Secolari. Infine, l’ultimo motivo è che presso gli uomini prudenti ed onesti si biasimavano le predette Società e Aggregazioni: a loro giudizio chiunque si iscriveva ad esse incorreva nella taccia di pravità e perversione.
8. Infine lo stesso Predecessore nella sopra riportata Costituzione esorta i Vescovi, i Superiori Prelati e gli altri Ordinari dei luoghi a non trascurare d’invocare l’aiuto del braccio secolare qualora occorra per l’esecuzione di tale disposizione.
9. Tutte queste cose, anche singolarmente, non solo si approvano e si confermano da Noi, ma anche si raccomandano e si ingiungono ai Superiori Ecclesiastici; ma Noi stessi, per debito della Apostolica sollecitudine, con la presente Nostra Lettera invochiamo e con vivo affetto ricerchiamo il soccorso e l’aiuto dei Principi Cattolici e dei secolari Poteri – essendo gli stessi Principi Supremi e Podestà eletti da Dio quali difensori della fede e protettori della Chiesa – affinché sia loro cura adoperarsi nel modo più efficace perché alle Apostoliche Costituzioni si abbiano il dovuto ossequio e la più assoluta obbedienza. Ciò riportarono alla loro memoria i Padri del Concilio Tridentino (sess. 25, cap. 20), e molto prima l’aveva egregiamente dichiarato l’Imperatore Carlo Magno nei suoi Capitolati (tit. I, cap. 2), nei quali, dopo aver comandato a tutti e i suoi sudditi l’osservanza delle Sanzioni Ecclesiastiche, aggiunse queste parole: “In nessun modo possiamo conoscere come possano essere fedeli a noi coloro che si mostrano infedeli a Dio e disubbidienti ai suoi sacerdoti”. Conseguentemente impose a tutti i Presidenti e ai Ministri delle sue province che obbligassero tutti e i singoli a prestare la dovuta obbedienza alle leggi della Chiesa. Inoltre comminò gravissime pene contro coloro che trascurassero di fare ciò, aggiungendo fra l’altro: “Coloro poi che in queste cose (il che non avvenga) saranno trovati negligenti e trasgressori, sappiano che non conserveranno gli onori nel nostro Impero, ancorché siano nostri figlioli; né avranno posto nel Palazzo, né con noi né coi nostri fedeli avranno società o comunanza, ma piuttosto pagheranno la pena nelle angustie e nelle ristrettezze”.
10. Vogliamo poi che alle copie della presente, ancorché stampate, sottoscritte di mano di qualche pubblico Notaio e munite del sigillo di persona costituita in dignità Ecclesiastica, sia prestata la stessa fede che si presterebbe alla Lettera se fosse esibita o mostrata nell’originale.
11. A nessuno dunque, assolutamente, sia permesso violare, o con temerario ardimento contraddire questa pagina della Nostra conferma, innovazione, approvazione, comandamento, invocazione, richiesta, decreto e volontà. Se qualcuno osasse tanto, sappia che incorrerà nello sdegno di Dio Onnipotente e dei Santi Apostoli Pietro e Paolo.

In perpetual memory.
We deem it right, with a new intervention of Our authority, to support and confirm - as just and serious reasons require it - the provident laws and sanctions of the Roman Pontiffs Our Predecessors: not only those laws and sanctions whose force or for the process of time or due to the carelessness of men we fear they may slow down or die out, but also those that have recently gained strength and full vigor.
1. In fact, Clement XII, Our Predecessor of happy memory, with his own Apostolic Letter of 28 April of the year of the Incarnation of the Lord 1738, the eighth year of his Pontificate - Letter addressed to all the faithful and which begins In eminenti - condemned for always and prohibited some Societies, Unions, Meetings, Assemblies, Conventicles or Aggregations commonly called the Freemasons or des Francs Maçons, or otherwise called, already widespread in certain countries at the time and which are now increasing more and more. He forbade all and individual Christians (under pain of excommunication to be incurred ipso facto without any declaration, from which no one could be absolved by others, except on the point of death, except the Roman Pontiff pro tempore) to attempt or dare to enter such Societies, propagate them or lend them favor or shelter, conceal them, subscribe to them, join or intervene in them, and more, as is more broadly and more widely contained in the same Letter. Here is the text.
2. “Clement Bishop, servant of the servants of God. To all the faithful, greetings and Apostolic Blessing.
Placed at the behest of Divine clemency, although unworthy, in the eminent See of the Apostolate, in order to fulfill the debt of the Pastoral Providence entrusted to Us, with assiduous diligence and with care, as far as it is granted to Us by Heaven, we have turned our thoughts to those things by which - the door to errors and vices closed - the integrity of the Orthodox religion is mainly preserved, and in these very difficult times the dangers of disorder are removed from the whole Catholic world.
Already for the same public fame we are known that they extend in every direction, and from day to day they are strengthened, some Societies, Unions, Meetings, Meetings, Conventicles or Aggregations commonly called the Freemasons or des Francs Maçons, or with other denominations called according to the variety of languages, in which with a close and secret alliance, according to their Laws and Statutes, men of any religion and sect unite among themselves, content with a certain affected appearance of natural honesty. Such Societies, with a strict oath taken on the Holy Scriptures, and with the exaggeration of grave penalties, are obliged to maintain an inviolable silence about the things they do secretly.
But since it is the nature of the crime to manifest itself and generate the noise that denounces it, it follows that the aforementioned Societies or Conventicles have produced this suspicion in the minds of the faithful, according to which for honest and prudent men to subscribe to those Aggregations it is the same as staining themselves with the infamy of wickedness and perversion: if they did not operate iniquitously, they would not hate the light so decisively. Such fame has grown so considerably, that these societies have already been outlawed by secular princes in many countries as enemies of the kingdoms, and have been providentially eliminated.
We therefore, meditating on the very serious damage that mostly these Societies or Conventicles cause not only to the tranquility of the temporal Republic, but also to the spiritual health of souls, as they do not in any way accord with either the Civil Laws or the Canonical ones; taught by the Divine words to watch day and night, as a faithful and prudent servant in charge of the Lord's family, so that this race of men does not plunder the House like thieves, nor like foxes ruin the Vineyard; that is, so that it does not corrupt the hearts of the simple or occultly injure the innocent; in order to close the road which, if open, could allow crimes with impunity; for other just and rational reasons known to Us, with the advice of some of Our Venerable Brother Cardinals of the Holy Roman Church, and again motu proprio, with sure knowledge, mature deliberation and with the fullness of Our Apostolic power, we decree that we must condemn and prohibit ourselves, as with this Our Constitution, to be valid in perpetuity, we condemn and prohibit the aforementioned Societies, Unions, Meetings, Meetings, Aggregations or Conventicles of Freemasons or des Francs Maçons, or with any other name called. Therefore, strictly, and by virtue of holy obedience, we command all and individual faithful of any state, grade, condition, order, dignity or pre-eminence, both lay people and clerics, both Seculars and Regulars, even if they are worthy of special and individual mention. And summons, that no one dare or presume under any pretext or appearance to establish, propagate or favor the aforementioned Societies of Freemasons or des Francs Maçons or otherwise denominated; to host and hide them in their homes or elsewhere; to subscribe and join them; to provide them with the means, faculty or possibility of meeting somewhere; to give them something or even to give advice, help or favor in any way, openly or in secret, directly or indirectly, on their own or for others, as well as to exhort, induce, provoke or persuade others to register or to intervene in similar Company, or in any way to benefit and favor them. Indeed, everyone must absolutely abstain from said Societies, Unions, Meetings, Meetings, Aggregations or Conventicles, under penalty of excommunication for all offenders, as above, to be incurred ipso facto, and without any declaration, from which no one can be acquitted, if not at the point of death, by others other than the Roman Pontiff pro tempore.
We also want and command that both the Bishops, the Superior Prelates and the other Ordinaries of the places, as well as the Inquisitors of heretical evil deputies in any place, proceed and inquire against transgressors of any state, degree, condition, order, dignity. or pre-eminence, and that they repress and punish them with the same penalties with which they strike suspects of heresy. Therefore, we grant and attribute free power to them, and to each of them, to proceed and investigate the aforementioned transgressors, and to imprison and punish them with due penalties, also invoking, if necessary, the help of the secular arm.
We also want that the copies of this letter, even if printed, signed by the hand of some public notary and bearing the seal of a person constituted in ecclesiastical dignity, be given the same faith that would be given to the Letter if it were exhibited or shown in the original.
Therefore, absolutely no one is permitted to violate, or with reckless daring to contradict this page of Our declaration, condemnation, commandment, prohibition and interdiction. If anyone dared so much, know that he will incur the indignation of Almighty God and of the Holy Apostles Peter and Paul ”.
3. But since, as far as we have been told, some have had no difficulty in affirming and publicly spreading that the said penalty of excommunication imposed by our Predecessor is no longer effective because the relative Constitution has not been confirmed by us, almost as if explicit confirmation of the successor is necessary for the Apostolic Constitutions to maintain validity;
4. and having been suggested to Us, by some pious and God-fearing people, that it would be very useful to eliminate all the subterfuges of the slanderers and to declare the uniformity of Our soul with the intention and will of the same Predecessor, adding to its Constitution the new vote of Our Confirmation;
5. We certainly, until now, when we have kindly granted absolution from the incurred excommunication, often before and mainly in the past year of the Jubilee, to many faithful truly repentant and grieving for having transgressed the laws of the Constitution itself and which they assured from the heart to move away completely from similar Societies and Conventicles, and that in the future they would never return there; or when we granted the Penitentiaries delegated by Us the faculty of imparting absolution in Our name and with Our authority to those who resorted to the Penitentiaries themselves; and when with solicitous vigilance we did not neglect to ensure that the competent Judges and Tribunals proceeded in proportion to the crime committed against violators of the Constitution itself, which was effectively carried out several times; we have certainly provided arguments that are not only probable but completely evident and indubitable, through which the dispositions of our soul and the firm and deliberate will consenting with the censure imposed by the aforementioned Clement Predecessor should have been understood. If a contrary opinion spread around Us, We could surely despise it and refer Our cause to the just judgment of Almighty God, uttering those words that were once recited in the course of sacred services: "Grant, O Lord, we pray to you, that We do not cure the slanders of perverse souls, but trampling perversity itself, we beg that You do not allow us to be afflicted by unjust slanders or enveloped in cunning flattery, but rather that we love what You command ”. Thus reports an ancient missal attributed to St. Gelasius, Our Predecessor, and which by the Venerable Servant of God Cardinal Giuseppe Maria Tommasi was included in the Mass entitled Against the slanderers.
6. However, so that it could not be said that We had imprudently omitted something, in order to easily eliminate the pretexts for lying slanders and shut their mouths; Having first heard the advice of some of Our Venerable Brother Cardinals of the Holy Roman Church, we have decreed to confirm the same Constitution of Our Predecessor, word for word, as reported above in a specific form, which is considered to be the broadest and most effective of all: We confirm, validate, renew and we want and decree that it has perpetual strength and efficacy for Our sure science, in the fullness of Our Apostolic authority, according to the tenor of the same Constitution, in all respects, as if it had been promulgated with Our motu proprio. and with Our authority, and had been published for the first time by Us.
7. In truth, among the very serious reasons for the aforementioned prohibitions and condemnation set out in the aforementioned Constitution, there is one, by virtue of which men of any religion and sect can mutually unite in such Societies and Conventicles; it is clear what damage can be done to the purity of the Catholic religion. The second reason is the strict and impenetrable promise of secrecy, by virtue of which what is done in these meetings is hidden, to which the sentence that Cecilio Natale, at Minucio Felice, adduced in a very different cause can be applied: "The honest things always love the public light; wickedness is secret ”. The third reason is the oath with which they undertake to inviolably observe this secret, as if it is lawful for someone, questioned by legitimate power, with the excuse of some promise or oath to evade the obligation to confess everything that is sought. , to know if in such Conventicles anything is done contrary to the stability and to the laws of Religion and the Republic. The fourth reason is that these Societies oppose the Civil Sanctions no less than the Canons, taking into account, in fact, that under the Civil Law all Colleges and meetings formed without public authority are prohibited, as stated in the Pandects (book 47, tit. 22, De Collegiis et corporibus illicitis), and in the famous letter (n. 97 of book 10) by C. Plinio Cecilio, who reports that it was forbidden by his Edict, according to the commandment of the Emperor, that the Aetheries were held, that is, that Societies and meetings could exist and meet without the authorization of the Prince. The fifth reason is that in many countries the aforementioned Companies and Aggregations have already been proscribed and banned with Secular Principle laws. Finally, the last reason is that prudent and honest men were blamed for the aforementioned Societies and Aggregations: in their opinion, anyone who joined them incurred the accusation of pravity and perversion.
8. Finally, the same Predecessor in the aforementioned Constitution exhorts the Bishops, the Superiors Prelates and the other Ordinaries of the places not to neglect to invoke the help of the secular arm if necessary for the execution of this provision.
9. All these things, even individually, are not only approved and confirmed by Us, but are also recommended and enjoined upon the Ecclesiastical Superiors; but We ourselves, out of debt of the apostolic solicitude, with this present letter invoke and with deep affection we seek the aid and help of the Catholic Princes and the secular Powers - being the Supreme Princes and Podestà themselves elected by God as defenders of the faith and protectors of the Church - so that it is their concern to do their utmost to ensure that the Apostolic Constitutions have due respect and absolute obedience. This brought to their memory by the Fathers of the Council of Trent (sess. 25, chap. 20), and much earlier the Emperor Charlemagne had admirably declared it in his Specifications (tit. I, chap. 2), in which, after having commanded all and his subjects to observe the Ecclesiastical Sanctions, he added these words: "In no way can we know how those who show themselves unfaithful to God and disobedient to his priests can be faithful to us". Consequently he imposed on all the Presidents and Ministers of his provinces that they oblige all and individuals to give due obedience to the laws of the Church. He also imposed very serious penalties against those who neglect to do this, adding among other things: "Those who in these things (which does not happen) will be found negligent and transgressors, know that they will not keep the honors in our Empire, even if they are ours children; they will neither have a place in the Palace, nor with us nor with our faithful will they have society or community, but rather they will pay the penalty in anguish and hardship ”.
10. We also want the copies of this letter, even if printed, signed by the hand of some public notary and bearing the seal of a person constituted in ecclesiastical dignity, to be given the same faith that would be given to the Letter if it were exhibited or shown in the original.
11. Therefore, absolutely no one is permitted to violate, or with reckless daring to contradict this page of Our confirmation, innovation, approval, commandment, invocation, request, decree and will. If anyone dared so much, know that he will incur the indignation of Almighty God and the Holy Apostles Peter and Paul.

Giudichiamo doveroso, con un nuovo intervento della Nostra autorità, sostenere e confermare – in quanto lo richiedono giusti e gravi motivi – le provvide leggi e le sanzioni dei Romani Pontefici Nostri Predecessori: non soltanto quelle leggi e quelle sanzioni il cui vigore o per il processo del tempo o per la noncuranza degli uomini temiamo si possano rallentare od estinguere, ma anche quelle che recentemente hanno ottenuto forza e pieno vigore.
1. Di fatto Clemente XII, Nostro Predecessore di felice memoria, con propria Lettera apostolica del 28 aprile dell’anno dell’Incarnazione del Signore 1738, anno ottavo del suo Pontificato – Lettera diretta a tutti i fedeli e che comincia In eminenti – condannò per sempre e proibì alcune Società, Unioni, Riunioni, Adunanze, Conventicole o Aggregazioni volgarmente chiamate dei Liberi Muratori o des Francs Maçons, o diversamente denominate, già allora largamente diffuse in certi Paesi e che ora sempre più aumentano. Egli vietò a tutti e ai singoli Cristiani (sotto pena di scomunica da incorrersi ipso facto senza alcuna dichiarazione, dalla quale nessuno potesse essere assolto da altri, se non in punto di morte, all’infuori del Romano Pontefice pro tempore) di tentare o ardire di entrare in siffatte Società, propagarle o prestare loro favore o ricetto, occultarle, iscriversi ad esse, aggregarsi o intervenirvi, ed altro, come nella stessa Lettera più largamente e più ampiamente è contenuto. 2. “Clemente Vescovo, servo dei servi di Dio. A tutti i fedeli, salute e Apostolica Benedizione.
Posti per volere della clemenza Divina, benché indegni, nell’eminente Sede dell’Apostolato, onde adempiere al debito della Pastorale provvidenza affidato a Noi, con assidua diligenza e con premura, per quanto Ci è concesso dal Cielo, abbiamo rivolto il pensiero a quelle cose per mezzo delle quali – chiuso l’adito agli errori ed ai vizi – si conservi principalmente l’integrità della Religione Ortodossa, e in questi tempi difficilissimi vengano allontanati da tutto il mondo Cattolico i pericoli dei disordini.
Già per la stessa pubblica fama Ci è noto che si estendono in ogni direzione, e di giorno in giorno si avvalorano, alcune Società, Unioni, Riunioni, Adunanze, Conventicole o Aggregazioni comunemente chiamate dei Liberi Muratori o des Francs Maçons, o con altre denominazioni chiamate a seconda della varietà delle lingue, nelle quali con stretta e segreta alleanza, secondo loro Leggi e Statuti, si uniscono tra di loro uomini di qualunque religione e setta, contenti di una certa affettata apparenza di naturale onestà. Tali Società, con stretto giuramento preso sulle Sacre Scritture, e con esagerazione di gravi pene, sono obbligate a mantenere un inviolabile silenzio intorno alle cose che esse compiono segretamente.
Ma essendo natura del delitto il manifestarsi da se stesso e generare il rumore che lo denuncia, ne deriva che le predette Società o Conventicole hanno prodotto tale sospetto nelle menti dei fedeli, secondo il quale per gli uomini onesti e prudenti l’iscriversi a quelle Aggregazioni è lo stesso che macchiarsi dell’infamia di malvagità e di perversione: se non operassero iniquamente, non odierebbero tanto decisamente la luce. Tale fama è cresciuta in modo così considerevole, che dette Società sono già state proscritte dai Principi secolari in molti Paesi come nemiche dei Regni, e sono state provvidamente eliminate.
Noi pertanto, meditando sui gravissimi danni che per lo più tali Società o Conventicole recano non solo alla tranquillità della temporale Repubblica, ma anche alla salute spirituale delle anime, in quanto non si accordano in alcun modo né con le Leggi Civili né con quelle Canoniche; ammaestrati dalle Divine parole di vigilare giorno e notte, come servo fedele e prudente preposto alla famiglia del Signore, affinché questa razza di uomini non saccheggi la Casa come ladri, né come le volpi rovini la Vigna; affinché, cioè, non corrompa i cuori dei semplici né ferisca occultamente gl’innocenti; allo scopo di chiudere la strada che, se aperta, potrebbe impunemente consentire dei delitti; per altri giusti e razionali motivi a Noi noti, con il consiglio di alcuni Venerabili Nostri Fratelli Cardinali della Santa Romana Chiesa, e ancora motu proprio, con sicura scienza, matura deliberazione e con la pienezza della Nostra Apostolica potestà, decretiamo doversi condannare e proibire, come con la presente Nostra Costituzione, da valere in perpetuo, condanniamo e proibiamo le predette Società, Unioni, Riunioni, Adunanze, Aggregazioni o Conventicole dei Liberi Muratori o des Francs Maçons, o con qualunque altro nome chiamate. Pertanto, severamente, ed in virtù di santa obbedienza, comandiamo a tutti ed ai singoli fedeli di qualunque stato, grado, condizione, ordine, dignità o preminenza, sia Laici, sia Chierici, tanto Secolari quanto Regolari, ancorché degni di speciale ed individuale menzione e citazione, che nessuno ardisca o presuma sotto qualunque pretesto o apparenza di istituire, propagare o favorire le predette Società dei Liberi Muratori o des Francs Maçons o altrimenti denominate; di ospitarle e nasconderle nelle proprie case o altrove; di iscriversi ed aggregarsi ad esse; di procurare loro mezzi, facoltà o possibilità di convocarsi in qualche luogo; di somministrare loro qualche cosa od anche di prestare in qualunque modo consiglio, aiuto o favore, palesemente o in segreto, direttamente o indirettamente, in proprio o per altri, nonché di esortare, indurre, provocare o persuadere altri ad iscriversi o ad intervenire a simili Società, od in qualunque modo a giovare e a favorire le medesime. Anzi, ognuno debba assolutamente astenersi dalle dette Società, Unioni, Riunioni, Adunanze, Aggregazioni o Conventicole, sotto pena di scomunica per tutti i contravventori, come sopra, da incorrersi ipso facto, e senza alcuna dichiarazione, dalla quale nessuno possa essere assolto, se non in punto di morte, da altri all’infuori del Romano Pontefice pro tempore.
Vogliamo inoltre e comandiamo che tanto i Vescovi, i Prelati Superiori e gli altri Ordinari dei luoghi, quanto gl’Inquisitori dell’eretica malvagità deputati in qualsiasi luogo, procedano e facciano inquisizione contro i trasgressori di qualunque stato, grado, condizione, ordine, dignità o preminenza, e che reprimano e puniscano i medesimi con le stesse pene con le quali colpiscono i sospetti di eresia. Pertanto concediamo e attribuiamo libera facoltà ad essi, e a ciascuno di essi, di procedere e di inquisire contro i suddetti trasgressori, e di imprigionarli e punirli con le debite pene, invocando anche, se sarà necessario, l’aiuto del braccio secolare.
Vogliamo poi che alle copie della presente, ancorché stampate, sottoscritte di mano di qualche pubblico Notaio e munite del sigillo di persona costituita in dignità Ecclesiastica, sia prestata la stessa fede che si presterebbe alla Lettera se fosse esibita o mostrata nell’originale.
A nessuno dunque, assolutamente, sia permesso violare, o con temerario ardimento contraddire questa pagina della Nostra dichiarazione, condanna, comandamento, proibizione ed interdizione. Se qualcuno osasse tanto, sappia che incorrerà nello sdegno di Dio Onnipotente e dei Santi Apostoli Pietro e Paolo”.
3. Ma poiché, per quanto Ci è stato riferito, alcuni non hanno avuto difficoltà di affermare e diffondere pubblicamente che la detta pena di scomunica imposta dal Nostro Predecessore non è più operante perché la relativa Costituzione non è poi stata da Noi confermata, quasi che sia necessaria, perché le Apostoliche Costituzioni mantengano validità, la conferma esplicita del successore;
4. ed essendo stato suggerito a Noi, da parte di alcune persone pie e timorate di Dio, che sarebbe assai utile eliminare tutti i sotterfugi dei calunniatori e dichiarare l’uniformità dell’animo Nostro con l’intenzione e la volontà dello stesso Predecessore, aggiungendo alla sua Costituzione il nuovo voto della Nostra conferma;
5. Noi certamente, fino ad ora, quando abbiamo benignamente concesso l’assoluzione dalla incorsa scomunica, sovente prima e principalmente nel passato anno del Giubileo, a molti fedeli veramente pentiti e dolenti di avere trasgredito le leggi della stessa Costituzione e che assicuravano di cuore di allontanarsi completamente da simili Società e Conventicole, e che per l’avvenire non vi sarebbero mai tornati; o quando accordammo ai Penitenzieri da Noi delegati la facoltà di impartire l’assoluzione a Nostro nome e con la Nostra autorità a coloro che ricorressero ai Penitenzieri stessi; e quando con sollecita vigilanza non tralasciammo di provvedere a che dai competenti Giudici e Tribunali si procedesse in proporzione del delitto compiuto contro i violatori della Costituzione stessa, il che fu effettivamente più volte eseguito; abbiamo certamente fornito argomenti non solo probabili ma del tutto evidenti ed indubitabili, attraverso i quali si sarebbero dovute comprendere le disposizioni dell’animo Nostro e la ferma e deliberata volontà consenzienti con la censura imposta dal predetto Clemente Predecessore. Se un’opinione contraria si divulgasse intorno a Noi, Noi potremmo sicuramente disprezzarla e rimettere la Nostra causa al giusto giudizio di Dio Onnipotente, pronunciando quelle parole che un tempo si recitavano nel corso delle sacre funzioni: “Concedi o Signore, te ne preghiamo, che Noi non curiamo le calunnie degli animi perversi, ma conculcata la perversità medesima supplichiamo che Tu non permetta che siamo afflitti dalle ingiuste maldicenze o avviluppati dalle astute adulazioni, ma che amiamo piuttosto ciò che Tu comandi”. Così riporta un antico Messale attribuito a San Gelasio, Nostro Predecessore, e che dal Venerabile Servo di Dio il Cardinale Giuseppe Maria Tommasi fu inserito nella Messa che s’intitola Contro i maldicenti.
6. Tuttavia, affinché non si potesse dire che Noi avevamo imprudentemente omesso qualche cosa, al fine di eliminare agevolmente i pretesti alle menzognere calunnie e chiudere loro la bocca; udito prima il consiglio di alcuni Venerabili Nostri Fratelli Cardinali della Santa Romana Chiesa, abbiamo decretato di confermare la stessa Costituzione del Nostro Predecessore, parola per parola, come sopra riportato in forma specifica, la quale sia considerata come la più ampia ed efficace di tutte: la confermiamo, convalidiamo, rinnoviamo e vogliamo e decretiamo che abbia perpetua forza ed efficacia per Nostra sicura scienza, nella pienezza della Nostra Apostolica autorità, secondo il tenore della medesima Costituzione, in tutto e per tutto, come se fosse stata promulgata con Nostro motu proprio e con la Nostra autorità, e fosse stata pubblicata per la prima volta da Noi.
7. Per la verità, fra i gravissimi motivi delle predette proibizioni e condanna esposti nella sopra riportata Costituzione ve n’è uno, in forza del quale in tali Società e Conventicole possano unirsi vicendevolmente uomini di qualsiasi religione e setta; è chiaro quale danno si possa recare alla purezza della Religione Cattolica. Il secondo motivo è la stretta e impenetrabile promessa di segreto, in forza del quale si nasconde ciò che si fa in queste adunanze, cui meritamente si può applicare quella sentenza che Cecilio Natale, presso Minucio Felice, addusse in una causa ben diversa: “Le cose oneste amano sempre la pubblica luce; le scelleratezze sono segrete”. Il terzo motivo è il giuramento con il quale s’impegnano ad osservare inviolabilmente detto segreto, quasi che sia lecito a qualcuno, interrogato da legittimo potere, con la scusa di qualche promessa o giuramento di sottrarsi all’obbligo di confessare tutto ciò che si ricerca, per conoscere se in tali Conventicole si faccia qualche cosa contraria alla stabilità e alle leggi della Religione e della Repubblica. Il quarto motivo è che queste Società si oppongono alle Sanzioni Civili non meno che alle Canoniche, tenuto conto, appunto, che ai sensi del Diritto Civile si vietano tutti i Collegi e le adunanze formati senza la pubblica autorità, come si legge nelle Pandette (libro 47, tit. 22, De Collegiis et corporibus illicitis), e nella celebre lettera (n. 97 del libro 10) di C. Plinio Cecilio, il quale, riferisce che fu proibito per suo Editto, giusta il comandamento dell’Imperatore, che si tenessero le Eterie, cioè che potessero esistere e riunirsi Società e adunanze senza l’autorizzazione del Principe. Il quinto motivo è che in molti Paesi le citate Società e Aggregazioni sono già state proscritte e bandite con leggi dei Principi Secolari. Infine, l’ultimo motivo è che presso gli uomini prudenti ed onesti si biasimavano le predette Società e Aggregazioni: a loro giudizio chiunque si iscriveva ad esse incorreva nella taccia di pravità e perversione.
8. Infine lo stesso Predecessore nella sopra riportata Costituzione esorta i Vescovi, i Superiori Prelati e gli altri Ordinari dei luoghi a non trascurare d’invocare l’aiuto del braccio secolare qualora occorra per l’esecuzione di tale disposizione.
9. Tutte queste cose, anche singolarmente, non solo si approvano e si confermano da Noi, ma anche si raccomandano e si ingiungono ai Superiori Ecclesiastici; ma Noi stessi, per debito della Apostolica sollecitudine, con la presente Nostra Lettera invochiamo e con vivo affetto ricerchiamo il soccorso e l’aiuto dei Principi Cattolici e dei secolari Poteri – essendo gli stessi Principi Supremi e Podestà eletti da Dio quali difensori della fede e protettori della Chiesa – affinché sia loro cura adoperarsi nel modo più efficace perché alle Apostoliche Costituzioni si abbiano il dovuto ossequio e la più assoluta obbedienza. Ciò riportarono alla loro memoria i Padri del Concilio Tridentino (sess. 25, cap. 20), e molto prima l’aveva egregiamente dichiarato l’Imperatore Carlo Magno nei suoi Capitolati (tit. I, cap. 2), nei quali, dopo aver comandato a tutti e i suoi sudditi l’osservanza delle Sanzioni Ecclesiastiche, aggiunse queste parole: “In nessun modo possiamo conoscere come possano essere fedeli a noi coloro che si mostrano infedeli a Dio e disubbidienti ai suoi sacerdoti”. Conseguentemente impose a tutti i Presidenti e ai Ministri delle sue province che obbligassero tutti e i singoli a prestare la dovuta obbedienza alle leggi della Chiesa. Inoltre comminò gravissime pene contro coloro che trascurassero di fare ciò, aggiungendo fra l’altro: “Coloro poi che in queste cose (il che non avvenga) saranno trovati negligenti e trasgressori, sappiano che non conserveranno gli onori nel nostro Impero, ancorché siano nostri figlioli; né avranno posto nel Palazzo, né con noi né coi nostri fedeli avranno società o comunanza, ma piuttosto pagheranno la pena nelle angustie e nelle ristrettezze”.
10. Vogliamo poi che alle copie della presente, ancorché stampate, sottoscritte di mano di qualche pubblico Notaio e munite del sigillo di persona costituita in dignità Ecclesiastica, sia prestata la stessa fede che si presterebbe alla Lettera se fosse esibita o mostrata nell’originale.
11. Already for the same public fame we are known that they extend in every direction, and from day to day they are strengthened, some Societies, Unions, Meetings, Meetings, Conventicles or Aggregations commonly called the Freemasons or des Francs Maçons, or with other denominations called according to the variety of languages, in which with a close and secret alliance, according to their Laws and Statutes, men of any religion and sect unite among themselves, content with a certain affected appearance of natural honesty. Such Societies, with a strict oath taken on the Holy Scriptures, and with the exaggeration of grave penalties, are obliged to maintain an inviolable silence about the things they do secretly.
But since it is the nature of the crime to manifest itself and generate the noise that denounces it, it follows that the aforementioned Societies or Conventicles have produced this suspicion in the minds of the faithful, according to which for honest and prudent men to subscribe to those Aggregations it is the same as staining themselves with the infamy of wickedness and perversion: if they did not operate iniquitously, they would not hate the light so decisively. Such fame has grown so considerably, that these societies have already been outlawed by secular princes in many countries as enemies of the kingdoms, and have been providentially eliminated.
We therefore, meditating on the very serious damage that mostly these Societies or Conventicles cause not only to the tranquility of the temporal Republic, but also to the spiritual health of souls, as they do not in any way accord with either the Civil Laws or the Canonical ones; taught by the Divine words to watch day and night, as a faithful and prudent servant in charge of the Lord's family, so that this race of men does not plunder the House like thieves, nor like foxes ruin the Vineyard; that is, so that it does not corrupt the hearts of the simple or occultly injure the innocent; in order to close the road which, if open, could allow crimes with impunity; for other just and rational reasons known to Us, with the advice of some of Our Venerable Brother Cardinals of the Holy Roman Church, and again motu proprio, with sure knowledge, mature deliberation and with the fullness of Our Apostolic power, we decree that we must condemn and prohibit ourselves, as with this Our Constitution, to be valid in perpetuity, we condemn and prohibit the aforementioned Societies, Unions, Meetings, Meetings, Aggregations or Conventicles of Freemasons or des Francs Maçons, or with any other name called. Therefore, strictly, and by virtue of holy obedience, we command all and individual faithful of any state, grade, condition, order, dignity or pre-eminence, both lay people and clerics, both Seculars and Regulars, even if they are worthy of special and individual mention. But since, as far as we have been told, some have had no difficulty in affirming and publicly spreading that the said penalty of excommunication imposed by our Predecessor is no longer effective because the relative Constitution has not been confirmed by us, almost as if explicit confirmation of the successor is necessary for the Apostolic Constitutions to maintain validity;
4. and having been suggested to Us, by some pious and God-fearing people, that it would be very useful to eliminate all the subterfuges of the slanderers and to declare the uniformity of Our soul with the intention and will of the same Predecessor, adding to its Constitution the new vote of Our Confirmation;
5. We certainly, until now, when we have kindly granted absolution from the incurred excommunication, often before and mainly in the past year of the Jubilee, to many faithful truly repentant and grieving for having transgressed the laws of the Constitution itself and which they assured from the heart to move away completely from similar Societies and Conventicles, and that in the future they would never return there; or when we granted the Penitentiaries delegated by Us the faculty of imparting absolution in Our name and with Our authority to those who resorted to the Penitentiaries themselves; and when with solicitous vigilance we did not neglect to ensure that the competent Judges and Tribunals proceeded in proportion to the crime committed against violators of the Constitution itself, which was effectively carried out several times; we have certainly provided arguments that are not only probable but completely evident and indubitable, through which the dispositions of our soul and the firm and deliberate will consenting with the censure imposed by the aforementioned Clement Predecessor should have been understood. If a contrary opinion spread around Us, We could surely despise it and refer Our cause to the just judgment of Almighty God, uttering those words that were once recited in the course of sacred services: "Grant, O Lord, we pray to you, that We do not cure the slanders of perverse souls, but trampling perversity itself, we beg that You do not allow us to be afflicted by unjust slanders or enveloped in cunning flattery, but rather that we love what You command ”. Thus reports an ancient missal attributed to St. Gelasius, Our Predecessor, and which by the Venerable Servant of God Cardinal Giuseppe Maria Tommasi was included in the Mass entitled Against the slanderers.
6. However, so that it could not be said that We had imprudently omitted something, in order to easily eliminate the pretexts for lying slanders and shut their mouths; Having first heard the advice of some of Our Venerable Brother Cardinals of the Holy Roman Church, we have decreed to confirm the same Constitution of Our Predecessor, word for word, as reported above in a specific form, which is considered to be the broadest and most effective of all: We confirm, validate, renew and we want and decree that it has perpetual strength and efficacy for Our sure science, in the fullness of Our Apostolic authority, according to the tenor of the same Constitution, in all respects, as if it had been promulgated with Our motu proprio. and with Our authority, and had been published for the first time by Us.
7. In truth, among the very serious reasons for the aforementioned prohibitions and condemnation set out in the aforementioned Constitution, there is one, by virtue of which men of any religion and sect can mutually unite in such Societies and Conventicles; it is clear what damage can be done to the purity of the Catholic religion. The second reason is the strict and impenetrable promise of secrecy, by virtue of which what is done in these meetings is hidden, to which the sentence that Cecilio Natale, at Minucio Felice, adduced in a very different cause can be applied: "The honest things always love the public light; wickedness is secret ”. The third reason is the oath with which they undertake to inviolably observe this secret, as if it is lawful for someone, questioned by legitimate power, with the excuse of some promise or oath to evade the obligation to confess everything that is sought. , to know if in such Conventicles anything is done contrary to the stability and to the laws of Religion and the Republic. The fourth reason is that these Societies oppose the Civil Sanctions no less than the Canons, taking into account, in fact, that under the Civil Law all Colleges and meetings formed without public authority are prohibited, as stated in the Pandects (book 47, tit. 22, De Collegiis et corporibus illicitis), and in the famous letter (n. 97 of book 10) by C. Plinio Cecilio, who reports that it was forbidden by his Edict, according to the commandment of the Emperor, that the Aetheries were held, that is, that Societies and meetings could exist and meet without the authorization of the Prince. The fifth reason is that in many countries the aforementioned Companies and Aggregations have already been proscribed and banned with Secular Principle laws. Finally, the last reason is that prudent and honest men were blamed for the aforementioned Societies and Aggregations: in their opinion, anyone who joined them incurred the accusation of pravity and perversion.
8. Finally, the same Predecessor in the aforementioned Constitution exhorts the Bishops, the Superiors Prelates and the other Ordinaries of the places not to neglect to invoke the help of the secular arm if necessary for the execution of this provision.
9. All these things, even individually, are not only approved and confirmed by Us, but are also recommended and enjoined upon the Ecclesiastical Superiors; but We ourselves, out of debt of the apostolic solicitude, with this present letter invoke and with deep affection we seek the aid and help of the Catholic Princes and the secular Powers - being the Supreme Princes and Podestà themselves elected by God as defenders of the faith and protectors of the Church - so that it is their concern to do their utmost to ensure that the Apostolic Constitutions have due respect and absolute obedience. This brought to their memory by the Fathers of the Council of Trent (sess. 25, chap. 20), and much earlier the Emperor Charlemagne had admirably declared it in his Specifications (tit. I, chap. 2), in which, after having commanded all and his subjects to observe the Ecclesiastical Sanctions, he added these words: "In no way can we know how those who show themselves unfaithful to God and disobedient to his priests can be faithful to us". Consequently he imposed on all the Presidents and Ministers of his provinces that they oblige all and individuals to give due obedience to the laws of the Church. He also imposed very serious penalties against those who neglect to do this, adding among other things: "Those who in these things (which does not happen) will be found negligent and transgressors, know that they will not keep the honors in our Empire, even if they are ours children; they will neither have a place in the Palace, nor with us nor with our faithful will they have society or community, but rather they will pay the penalty in anguish and hardship ”.
10. We also want the copies of this letter, even if printed, signed by the hand of some public notary and bearing the seal of a person constituted in ecclesiastical dignity, to be given the same faith that would be given to the Letter if it were exhibited or shown in the original.
11. Therefore, absolutely no one is permitted to violate, or with reckless daring to contradict this page of Our confirmation, innovation, approval, commandment, invocation, request, decree and will. If anyone dared so much, know that he will incur the indignation of Almighty God and the Holy Apostles Peter and Paul.
